Privacy Notice – Sellpy Careers and Recruitment
This privacy notice applies to all applicants and prospective candidates. Where appropriate in the context of this notice, the term “recruitment” also applies to “individual applications,” “referrals,” and “agency recruitment.”
This privacy notice may also apply to family members, next of kin, referees, and/or job seekers referred by you. If you provide Sellpy with information about such third parties, you are responsible for forwarding this information to the relevant individuals.
Who is responsible for your personal data?
Sellhelp AB and/or Sellhelp GmbH and/or Sellhelp SRL and/or Sellhelp Sp. z o.o. (referred to as “we,” “us,” or “Sellpy”) is the data controller under applicable data protection laws, unless explicitly stated otherwise in the respective sections below.
When can we process your personal data?
We will only collect, process, use or store personal data if we have valid and lawful reasons to do so. Your personal data may be processed by us based on reasons derived from the following: pre-employment contract or collective agreements (contract), statutory obligations (legal requirement), your consent (consent), or our legitimate interest as an employer (legitimate interest). For each specific processing purpose, we will inform you about which legal ground that will apply.
Why do we process your personal data?
The main purposes of processing your personal data are to recruit suitable internal or external candidates and manage potential candidates. Your personal data may be used to:
Identify, evaluate, and communicate with potential candidates;
Screen, select, and assess candidates for vacancies;
Build and maintain talent acquisition pipelines (e.g. job alerts, job matching, or employer branding materials).
Where necessary, we may use automated systems, including profiling and/or assisted decision-making, to screen applicants. The source of such data may include information from your application, ongoing process inputs, or past applications. These tools help speed up the process as well as to ensure fair and objective evaluations. You may request an explanation or challenge the result by contacting the email provided in this notice or your recruiter.
What types of data do we process?
We process personal data provided either by you or by a third party. When you submit your application, the categories we process include:
Contact details (name, email, address, phone number)
Date of birth
Employment and education history
Skills, certifications, and other CV information
References
Recruitment records (interview notes, test results, responses etc.)
Video, photo, and audio
We do not request sensitive personal data (e.g., racial/ethnic origin, political views, religious beliefs, union membership, health, sexual orientation). Please avoid including such information unless legally required or necessary for Sellpy to comply with legal obligations.
What is the legal basis for processing your data?
Candidate selection and contract negotiation are based on fulfilment of contract. Recruitment process optimization is based on our legitimate interest. Talent pool management, referral programs, reference data, job fairs, and surveys are also based on our legitimate interest. Employer branding and job alerts (via our career site) are based on your consent.
How long do we keep your data?
We will keep your personal data for as long as necessary to fulfill the purposes for which the personal data was collected.
Where do we store your data?
Data collected by Sellpy may be stored in the country where the Sellpy company is established, in a country within the European Economic Area (“EEA”), and/or transferred to and processed in a country outside the EEA if this is necessary to perform certain tasks or achieve specific purposes etc. Any cross-border transfer of your personal data will be done in accordance with applicable laws.
When applicable, for transfers from an EEA country to a non-EEA country that has not received an adequacy decision from the European Commission, Sellpy uses Standard Contractual Clauses and other permitted safeguards to protect your privacy and other rights during and after the cross-border transfer.
Who has access to your personal data?
Only Sellpy has access to your personal data, including its contracted suppliers and trusted partners who perform tasks on its behalf. We may also share personal data with other legal entities within the Sellpy group of companies, when necessary to fulfill the intended purpose of processing, however, without compromising your rights.
Please note that many of these third parties have an independent right or obligation to process your personal data in their own responsibility. We may share your personal data with external parties under the following circumstances:

What is the legal grounds for processing?
We will not collect, process, use, store etc. personal data without a valid legal ground. Legal grounds may be derived from your pre-employment contract or collective agreements, statutory obligations, your consent, or our legitimate interest as an employer. For each specific processing purpose, we will inform you about which legal ground that will apply, and what rights you are entitled to exercise.
What are your rights?
Right to access: You have the right to request information about the personal data we hold on you at any time.
Right to portability: Whenever Sellpy processes your personal data by automated means based on your consent or based on an agreement, you have the right to a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.
Right to rectification: You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.
Right to erasure: You have the right to request erasure of your personal data processed by us at any time. Your personal data may continue to be processed under certain circumstances, we will fully erase your personal data once it is no longer necessary for the purpose for which we originally collected or processed it, or when we are no longer legally required to process it.
Right to object to processing based on our legitimate interest: You have the right to object to processing of your personal data that is based on our legitimate interest. We will stop processing and delete your personal data, unless we can demonstrate a legitimate reason for the processing which overrides your interest and rights or due to legal claims, legitimate grounds or legal claims.
In cases where your personal data has been processed via an automated decision making or profiling procedure, you have the right to obtain an explanation and challenge the decision reached.
- Right to restriction of processing: You may request that Sellpy restricts the process of your personal data under the following circumstances:
If you object to a processing based on our legitimate interest, we will restrict all processing of such data pending the verification of the legitimate interest,
If you believe your data is incorrect, we must restrict all processing of such data pending the verification of the accuracy of the personal data ,
If the processing is unlawful, you can oppose the erasure of personal data and instead request the restriction of the use of your personal data,
if we no longer need your personal data, but it is required by you to make or defend legal claims.
